The TUPE (Transfer of Undertakings Protection of Employment) process can feel overwhelming, but we’re here to clarify some of the most common misconceptions and questions.
👉 Myth: Everything will change the moment the transfer happens.
On day one, your role, pay and hours will remain the same. If any changes are planned, they will follow a formal consultation process, just like they do now.
👉 Myth: I can choose not to transfer.
If your role is eligible for TUPE, it will automatically transfer to the new provider. Your current employer will talk you through your legal rights in regards to this and the process and implications for if you wish to opt out of the transfer.
👉 Myth: Non-NHS organisations can’t offer NHS pensions.
Thanks to the Fair Deal policy, you’ll keep your NHS Pension and employer contributions for as long as you pay into it. Nothing changes here!
👉 Myth: There will be immediate job cuts.
Our focus is on safely transferring services. If changes do happen once you have transferred to the new provider, they will follow a formal consultation process and work with you on available options.
👉 Myth: These won’t carry over.
Your current agreements and adjustments will transfer with you, and the new provider can explore with you upon transfer that these continue to be fully supported.
👉 Myth: Existing apprenticeships or career development opportunities won’t be supported.
We’ll work with the new provider to transfer any ongoing training. You can discuss ongoing or new training opportunities with the new provider during consultations.
👉 Myth: I’ll lose my perks and benefits after the transfer
Perks like the Blue Light Card will still be available, and your annual leave, including any increases based on length of service, will transfer with you.
👉 Myth: I’ll have to figure these things out myself.
IT equipment will be collected by your current employer ahead of your transfer. The new provider will supply new equipment, uniform and any additional resources at the point of transfer. Details about this can be clarified with them during the transfer process.
👉 Myth: My payday is changing, and it will leave me short
Your payday may change to meet that of the new provider. This can be discussed during the transfer period and we will confirm payday dates with you ahead of go-live.
